Terms and Conditions

Conditions:

By booking with Seascape (Oceano Diligente Unipessoal Lda) you are entering into a contract with us under the following conditions:

1. You must arrive for your trip at the pre-determined meeting point no less than 10 minutes before the scheduled departure time and no refunds can be given for late arrivals.

2. Refunds can only be giving in exceptional circumstances e.g. illness which can be proved, adverse weather conditions, mechanical problems on our side etc.

3. Dolphin watching trips are a non-guatenteed service, dolphins and in fact all wildlife are wild animals and we cannot guarantee that you will see them although we make every effort to do so, no refund or repeat trip can be given in the event of not seeing dolphins or other marine wildlife.

4. Fishing trips are non-refundable, we aim to get you to a location where it is possible to catch and release fish, however we cannot guarantee that this will be accomplished.

5. We reserve the right to cancel and re-book or refund trips due to adverse conditions or circumstances beyond our control.

6. We reserve the right not to carry young children or people with spinal conditions, cardiac conditions, physical or mental impairments in adverse weather conditions as determined by our staff at the time of the trip, this is based solely on safety considerations and in no way affects your statutory rights nor does it infer any discrimination, a refund or rebooking (if available) will be offered.

7. It is up to you to inform us of any medical condition which may affect your participation in a trip, it is also your responsibility to immediately bring to the attention of our staff any situation which may arise in which you are not comfortable.

8. You travel at your own risk on our services.

9. On dolphin, grotto and fishing trips we do not offer refreshments or toilet facilities so it is up to you to make sure you are prepared.

10. Any inappropriate behavior as determined by our staff will result in termination of the trip and an immediate return to port, any expenses caused by this for example refund or re-booking other clients will be payable by the offending party.

11.The decision of our staff will be considered final and any complaints should be made to us in writing within 7 days of the end of the trip.

12. We operate an e-ticket system which means you will have to present your booking email for check-in purposes, if this is not possible then it is up to you to pass by our office to obtain a printed version free of charge.

13. We will not use your email address or phone number for any other purposes except those directly connected with your booking which includes but is not limited to: booking and payment confirmation, issue of your e-ticket, changes to schedule or cancellations.

14. Whilst we strive to provide the best service and experience we can, we do realise that occasionally problems can arise, you agree to bring this to our attention and we are given the opportunity to offer a solution to the issue before you post any negative feedback on websites such as but not limited to: Facebook, Trip Advisor, Google + etc. Should negative feedback arise then we reserve the right to refer the website administrators to these terms and conditions.

15. Should a delay in your service occur, we will not be held liable for costs incurred by yourselves, such as parking charges, cancellation of other activities, missed travel connections, social events etc. If our trips are behind schedule for any reason and you need to rebook or be refunded for any legitimate reason then we will offer a refund or rebooking (if available).

16. You agree to listen to, and adhere to the safety briefing give by our staff at the start of every trip and ask a staff member if you are not sure of any aspect of it. During the trip you agree to follow the instructions of the staff at all times.

17. We accept no responsibility to any item of goods or clothing either lost or damaged by water or impact or any other means during any of our trips, items of value should not be brought on a trip especially if there are adverse conditions, all items are brought on board at you own risk.

18. Should you suffer from seasickness then it is your responsibility to take appropriate medication at a suitable time before the start of the trip, we cannot cancel or return to port except in extreme cases, which should be brought to the attention of our staff immediately.

19. You agree to wear a lifejacket which we will provide for the entire trip (except luxury charters, in which case we strongly recommend you wear a lifejacket at all times).

20. We will not carry passengers who are clearly intoxicated with either alcohol or restricted substances (drugs) and the carriage or consumption of alcohol or restricted substances is strictly forbidden with the exception of alcohol on luxury charters in which case this must be served by the crew at their discretion.

21. We do not tolerate at abusive behaviour towards our staff or clients be it physical or verbal or otherwise and any such behaviour will result in imediato termination of services with no refund considered. In extreme cases we reserve the right report to the relevant authorities.

22. For all trips we operate a policy of responsibility to wildlife under the guidance of the RYA Green Wildlife Guide for Boaters (The Green Bue Code). All passengers must abide by the advice & instructions given by our staff in relation to this.

23. Our minimum number of clients for a Dolphin Watching Trip is 4 people and a Grotto Trip is 2 people, this is just to cover the bare minimum of our costs and we cannot go out for any less than this, if the trip is booked for less than the minimum amount of people specified then we will either book you with another company, book you on a later trip with the minimum number, or give you a complete refund at your discretion.
